The FBI and Department of Justice’s pivotal role during the 2016 race for the White House continued to emerge in recent weeks, with the agency’s use of ‘302 forms’ taking center stage regarding Hillary Clinton’s email probe, FISA applications, Russian interference, and more.
The document -an FD-302- is an official “report” or “summary” of a spoken interview conducted by an FBI agent and an outside individual; as current guidelines prevent the agency from recording interviews with electronic devices.
The “interview memo” typically contains the date of the interview, the location, and a summary of the witness’s statement.
Critics of the form claim the document acts a “perjury trap” where the subject of the 302 could potentially expose themselves to making “false statements” while speaking with a Grand Jury months after the initial interview.
