Speaker 2 (00:03):
I'm Drew Nelson. A man in Florida is arrested more
than thirty three years after a woman was found stabbed
to death in a grassy field outside Saint Cloud. On Monday,
police arrested seventy two year old Gene Stuller at his
home in a Popka. He is charged with second degree
murder and disturbing a dead body in the nineteen ninety
one killing of twenty seven year old Julius Sue will Banks.

(00:24):
Her body was found September twenty third, nineteen ninety one,
off Neptune Road. She had sharp force wounds to her heart.

Speaker 3 (00:31):
Brutally stabbed approximately seventeen times. In early twenty twenty five,
this investigation led us to a primary suspect, Gene A. Stuller.
In March of this year, our detectives conducted surveillance and
successfully obtained a discarded item, a straw containing Steller's DNA.

Speaker 2 (00:49):
That's a Popka Police Chief Douglas Gurky. Early DNA testing
from the nineties found blood on the shorts that will
Banks was wearing. No matches were made at the time.
The twenty twelve police sent the DNA to a public
database for genealogy tracking earlier this year that led to Stuller.
Lab results showed it was one point nine trillion times

(01:10):
more likely the DNA came from Stuller than anyone else.
He had lived just about two miles from willbanks last
known address in ninety one. Chief Gurkey says, quote, cold
cases are never forgotten. This case represents not just the
power of persistence and science, but our unwaivering commitment to
honor victims and served their families even when justice takes time.

(01:30):
Stiller has passed arrests for DUI and drug paraphernalia, but
no felonies. One of his neighbors on we sh hasn't
come to grips with Steller's arrest yet.

Speaker 1 (01:39):
Kind of depressing to me.

Speaker 2 (01:41):
I like the guy.

Speaker 1 (01:41):
He's always been a good guy. I'm wanna missing.

Speaker 2 (01:45):
Willbanks had a history of drug use and was living
at a motel and Orange Blossom Trail. She had been
arrested before on charges including possession and prostitution. Police have
not shared a motive in the case. Stuller remains in
custody at Osciola County Jail. More Crime and Justice news.
After this Harvey Weinstein is back in a New York

(02:11):
court room as opening arguments begin in his retrial for
rape and sexual assault. A jury made up of seven
women and five men will decide whether the seventy three
year old former film producer is guilty of three alleged
sex crimes, third degree rape two counts of first degree
criminal sexual act. The retrial was ordered after New York's
top court overturned his twenty twenty conviction last year, ruling

(02:34):
that the original judge had allowed prejudicial testimony. That conviction
carried a twenty three year sentence. Weinstein has denied all
allegations and pleaded not guilty again, being tried on charges
related to three women. Former production assistant Miriam Hayley, aspiring
actress Jessica Mann, and an unnamed woman who accuses him
of forcing oral sex in a Manhattan hotel in two

(02:57):
thousand and six. Man and Hailey had also testified at
his original trial. The retrial in Manhattan began last week
with jury selection. Hundreds of potential jurors were dismissed. One
man who was excused said, quote, the first word that
came into my head was pig. Another said the hashtag
me Too movement had quote gone too far. Prosecutors and

(03:18):
the defense questioned remaining candidates about their views on sexual assault,
celebrities and the me Too movement that first brought Weinstein's
actions to light. Prosecutors Shannon Lucy asked jurors, quote, is
there anyone who is going to think of the movement
and think, Okay, that's just something that i have to
keep in the back of my mind when I'm deciding
the case. All twelve jurors said they could set that aside.

(03:40):
Weinstein's retrial is happening in the same courthouse where he
was convicted five years ago. The new judge, Curtis Farber,
has allowed him to stay at Bellevue Hospital during the
trial instead of being taken back to Rikers Island Jail,
citing his poor health. Weinstein's lawyers argued that returning to
Rikers could kill him. Judge Farbar agreed, saying, quote to

(04:00):
not do so could lead to exacerbation of and further
serious medical conditions and possibly death. Weinstein has been in
failing health, suffering from leukemia, heart disease, diabetes, and spinal issues.
His lawyers said he was mistreated at Rikers often denied
proper medication and exposed to unhygienic conditions. In September, he

(04:21):
underwent emergency heart surgery. More than one hundred women have
accused him of sexual abuse going back decades. In twenty seventeen,
expos as in The New York Times and The New
Yorker revealed the pattern of harassment and assault. Soon after,
Weinstein was fired from his company, expelled from Hollywood's top organizations,
and denounced by many political allies. His wife, Georgina Chapman,

(04:43):
left him. His first criminal trial and twenty twenty ended
in conviction for assaulting Haley and raping Man. He was
acquitted of more serious predatory charges. In twenty twenty two.
A separate trial in Los Angeles led to another conviction
for rape and a sixteen year prison sentence. That sentence
is under appeal. His overturned New York conviction led to
widespread concern among victims advocates, with Ashley Judd saying quote,

(05:07):
that is unfair to survivors. We still live in our truth.
Actress Rosanna Arquette quote, I am beyond disappointed. Rose Mcowen quote.
They cannot take away what we've gone through. Weinstein is
now being housed in Bellevue's secure medical unit during the retrial.
He still faces civil suits and a forty five million
dollar loan dispute with his brother Bob. He's also filed

(05:29):
a five million dollar suit against New York over conditions
at Riker's. If he's convicted again, Weinstein could spend the
rest of his life behind bars. He continues to insist
he is innocent, saying quote, I want justice for myself.

Speaker 1 (05:56):
How could a beautiful, young first grade teacher be stapped
twenty times, including in the back, allegedly die of suicide? Yes,
that was the medical examiner's official ruling after a closed
door meeting. He first named it a homicide. Why what
Happened to Ellen Greenberg? A huge American miscarriage of justice.
